- Sweepstakes Period: The Sweepstakes begins 12:01 a.m. ET December 13, 2010 and ends 11:59 p.m. ET March 31, 2011.
- Entry Online: Go online to www.oncewickedalwaysdead.com and follow the links and instructions to register and complete the Sweepstakes entry form. Completion of the entry form requires viewing a (“trailer”) video online, and observing places where the book title “Once Wicked Always Dead” appears hidden three (3) different times (the title on the book cover does not qualify as one of the hidden titles). The hidden appearances are both the title as a single phrase two (2) times and one (1) combination of four (4) separate single words making up the title. Once you have submitted all required information, you will receive one (1) entry into the Sweepstakes. Residents of the state of Oregon may participate only by "entry by mail" as described below.
- Entry by Mail: To enter the sweepstakes without using online method above, you may send a 3" x 5" card in a stamped #10 envelope, hand-printed addressed to: Once Wicked Always Dead Hidden Challenge Sweepstakes, c/o BRANDCOMET, P.O. Box 947819, Maitland, FL 32794-7819. On the card, hand print your name, complete residence address, evening (home) telephone number, and daytime (work) telephone number and answer the following questions:
1) What color is the cover of the book?
Each entry must be mailed separately. No mechanically reproduced entries accepted. All mailed entries must be postmarked no later than March 31, 2011 and received by April 7, 2011. All entries become the property of Sponsor and will not be returned. Limit of one (1) entry per participant regardless of the method of entry.
2) What famous author is T. Marie Benchley related to (hint he wrote Jaws)?
3) Did you watch the Video Book Trailer on www.TMarieBenchley.com? - Entry Restrictions: All (online) submissions must be received by 11:59 p.m. ET on March 31, 2011. Limit one (1) entry per participant (email address). In the event of a dispute as to the identity of any participant, the authorized account holder of the email address used to enter will be deemed to be the registered participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential Winners may be required to show proof of being the authorized account holder. All submissions, and the information contained thereon, become the exclusive property of Sponsor, including full rights for any promotional use, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor and its agents are not responsible for lost, late, incomplete, invalid, unintelligible, profane, illegible, duplicate, or misdirected submissions, all of which will be disqualified. The use of any automated, robotic, mechanical, or repeatable system to participate, submit, or complete entries is prohibited and will result in disqualification of all entries from those individual participants / email addresses.
- Prizes: There are three (3) prizes. One (1) Grand Prize Winner will receive a $1000. check. One (1) First Prize Winner will receive a $500. check. One (1) Second Prize Winner will receive a $100. check. The total Approximate Retail Value (ARV) of all prizes to be awarded is $1,600.
- Prize Restrictions: Winners are responsible for all applicable federal, state, and local taxes and fees associated with prize receipt and use. All personal expenses related to participation in the Sweepstakes and acceptance and use of any prize, are the sole responsibility of the participants and Winners. Any difference between the stated Approximate Retail Value and actual value of prize will not be awarded. Prizes will only be awarded if adequate eligible successful entry submissions are made and all unclaimed prizes will not be awarded. Winners must sign and return an Affidavit of Eligibility and Liability / Publicity Release prior to award. Prizes are non-transferable, non-refundable, and can only be accepted as awarded. No substitution, assignment, or transfer of prize may be made, except by Sponsor who reserves the right, in its sole discretion, to substitute any prize or portion of prize with another of equal or greater value.
- Winner Selections: On or about April 10, 2011, BRANDCOMET, a marketing promotion agency, acting as an independent judging organization, whose decisions as to the administration and operation of the Sweepstakes and the selection of Potential Winners are final, will randomly select one (1) Grand Prize Winner, one (1) First Place Winner, and one (1) Second Place Winner from all eligible successful entries received during the Sweepstakes Period.
- Winner Verification: Participants who are notified that their entries were selected in the random drawing are Potential Winners. A Potential Winner is not a confirmed Winner until he / she has returned all required documentation and his / her eligibility has been verified and confirmed by BRANDCOMET as independent judge and / or Sponsor. Potential Winners must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Potential Winners will be notified by email, telephone, or U.S. mail within seven (7) calendar days of the random drawing. Except where prohibited, all Potential Winners must sign and return to BRANDCOMET as independent judge, within ten (10) calendar days of the date attempted notice is sent, a complete Affidavit of Eligibility and Liability / Publicity Release (and such other documents as BRANDCOMET as independent judge may reasonably require to verify winner’s eligibility) in order to claim his / her prize. If a Potential Winner cannot be contacted, or fails to sign and return a completed Affidavit of Eligibility and Liability / Publicity Release within the required time period, Potential Winner is disqualified, and forfeits prize with no further rights. If the prize notification or the prize is returned as undeliverable, the prize will be forfeited, with no further rights, and attempts will be made to award to an alternate winner. In the event that a Potential Winner is disqualified or prize can not be awarded for any reason, BRANDCOMET as independent judge will attempt (up to three [3] times) to award the prize to a randomly selected alternate Potential Winner among eligible successful entries.
- Odds of Winning: The odds of being selected as a Winner in drawing depends on the number of eligible successful entries received for the drawing during the Sweepstakes Period.
- Eligibility: Open only to legal residents of the 50 United States and the District of Columbia who are at least 18 years old at the time of participation. Employees of Sponsor M.M.W.E. Publishing House, and their respective affiliated and subsidiary companies, as well as employees of their marketing and advertising agencies (collectively, the “Releasees”), as well as their Immediate Family (“Immediate Family” includes spouses, grandparents, parents, siblings, children, grandchildren, regardless of where they live, and any other legal dependents or household members, whether related or not) of each such employee, are not eligible. Void in Puerto Rico, U.S. Territories, and where prohibited by law; subject to all federal, state, local laws and regulations.
- Agreement to Official Rules: By participating in the Sweepstakes, all participants fully understand and unconditionally agree to and accept each and every one of these Official Rules, and the actions and decisions of Sponsor or BRANDCOMET as independent judge, which are final and binding in all respects.
- Publicity: Except where prohibited by law, participation in the Sweepstakes constitutes Winner’s full consent to Sponsor’s and marketing promotion agency’s use of Winner’s name, likeness, voice, opinions, biographical and demographic information, residence town and state. for promotional purposes in any media at any time without any further payment or consideration.
- General Conditions: Sponsor reserves the right to cancel, terminate, suspend or modify the Sweepstakes if fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the non-suspect eligible successful entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the operation of the Sweepstakes or to be acting in violation of these Official Rules or in any unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.
- Release: By receipt of any Sweepstakes prize, Winners agree to release and hold harmless Releasees, and each of their respective officers, directors, employees, contractors, and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt, use, or enjoyment of any prize. Each Sweepstakes participant agrees to release and forever discharge any and all claims, legal or equitable, known or unknown, participant had, now has, or may have, arising from this Sweepstakes against, including but not limited to, respective past and present officials, officers, directors, representatives, agents, members, volunteers and employees of the Releasees, or any other person or persons, firm, corporation, association, partnership or entity acting on their behalf, and all other related business entities of any type owned and operated at this time, or at any past time by the Releasees.
- Limitations of Liability: Releasees are not responsible for: (1) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software; (2) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (3) unauthorized human intervention in any part of the Sweepstakes; (4) electronic or human error which may occur in the administration of the Sweepstakes; (5) printing or typographical errors in any Sweepstakes-related materials; (6) for stolen, lost, late, misdirected, postage-due, damaged, incomplete, inaccurate entries or mail, or for entries that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; (7) electronic, computer, or telephonic malfunction or error, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes, or inability to access any web site associated with this promotion, or process any action thereon; or (8) any injury or damage to persons or property, including but not limited to any computer, hardware, or software, which may be caused, directly or indirectly, in whole or in part, from participation in the Sweepstakes or receipt, use, or enjoyment of any prize.
- Claims: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida, Hillsborough County, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida and Hillsborough County. Participants agree to waive all defenses to jurisdiction and agree to submit to exclusive jurisdiction in Hillsborough County, Florida for any legal proceeding between the participants and Sponsor for any purpose. Participants agree that disputes arising under these Official Rules shall be first submitted to arbitration in accordance with the state arbitration laws of Florida (Chapter 682, Florida Statutes). Notices shall be in writing and deemed given and received when delivered in person, by certified mail, or by major commercial courier.
- Personal Information: Information collected from participants will be used only for the purpose of the prize drawing and to notify winners, and will not be re-used, sold, or shared in any manner by Sponsor or any third parties unless participant has voluntarily and specifically elected to receive additional information or promotional material from Sponsor or a third party partner of the Sponsor. Potential Grand Prize Winner will be requested to provide his / her social security number which will be used only to report the Grand Prize Winner's prize earnings to the internal revenue service, as required by law. By participating in the Sweepstakes, all participants agree to all of the terms and conditions of Sponsor’s Privacy Policy (in summary above).
- Winners’ List: Sweepstakes results may be obtained by sending a self-addressed, stamped #10 envelope to “Once Wicked Always Dead $1000. Hidden Challenge Sweepstakes Winners’ List”, c/o BRANDCOMET, P.O. Box 947819, Maitland, FL 32794-7819. Requests must be received no later than March 31, 2011.
